Can You Build a Shed or Garage Over a Filled-In Pool?

Building a shed over a filled-in pool is possible in many cases, but what you can build, and how complex the process is, depends almost entirely on how the pool was filled. A light garden shed on an engineered, well-compacted fill is usually fine; a garage or granny flat typically needs a structural engineer’s assessment and may require full pool removal first. Why the fill method decides what you can build

When a pool is filled in, the excavated void is replaced with imported material, usually a mix of crushed concrete, road base, and topsoil. If that fill is compacted in controlled layers to a certified standard (typically Standard Proctor or Modified Proctor), the resulting ground can carry meaningful loads. If the fill was done informally, that is, the pool was simply filled with whatever was available and not tested, you may have a loose, voidy mass that will settle for years.

This is why fill method matters:

  • Partial fill-in (pool shell left in place, void filled): The shell acts as a permanent form. Useful for some structures, but the pool walls are not designed as footings, and long-term differential settlement is a risk.
  • Full removal with engineered fill: The cleanest base. With a certified compaction test (dry density ratio to Proctor standard), a structural engineer can design appropriate footings for almost any structure.

Sheds: usually possible on engineered fill

A lightweight garden or storage shed (Colorbond or timber, no habitable use) is the most forgiving structure to build over a filled pool site. What you typically need:

  • Evidence of engineered fill and compaction (a compaction report from the original removal)
  • Standard concrete slab footings, possibly thickened edge for stability
  • A certifier or council approval if the shed is above the exempt development size threshold (in NSW, generally 20 sqm or under on residential land for exempt development, subject to other conditions)

NSW Exempt and Complying Development provisions under NSW Exempt and Complying Development allow many sheds to be built without a full DA, but the site conditions (including filled ground) may still require a certifier to sign off.

Garages & carports: engineer required

A garage or carport sits in a different category. A double garage can weigh 5-10 tonnes (frame, roof, concrete floor), and a vehicle adds another 1.5-2.5 tonnes. That load, concentrated on footings above what was a void, needs engineering sign-off.

Granny flats & habitable structures: full removal usually needed

A granny flat or studio must meet the habitable room standards under the National Construction Code. Certifiers and structural engineers will scrutinise the ground conditions far more carefully for a structure where people sleep.

In practice, most certifiers and engineers will require one of:

  1. Full pool removal with engineered fill, compaction certificate, and engineer-designed footings.
  2. Piled foundations that bypass the fill layer entirely, bearing on competent natural ground below. Piles add significant cost (often $15,000-$40,000 or more depending on depth and number).

A partial fill-in (shell retained, void filled) is almost never accepted as an adequate base for a habitable structure. If a granny flat is your eventual goal, factor this into your decision between partial vs full pool removal.

What council & certifiers want to see

Regardless of structure type, bring the following to any approval conversation:

  • The original pool removal approval (DA or CDC)
  • The completion/sign-off documentation from the certifier who inspected the fill
  • Any compaction test report (ideally showing dry density ratio results layer by layer)
  • Photographs of the staged backfill process (most reputable contractors take these)
